(Funoni.com). Funoni Inc. (Funoni.com) may set the prices for the tickets listed on Funoni Inc. (Funoni.com). Funoni Inc. (Funoni.com) connects buyers and sellers. Funoni Inc. (Funoni.com) provides a marketplace that allows users(e.g end users, Funoni members etc.) to buy tickets listed on funoni.com from sellers. As a marketplace, we do not own the tickets listed on Funoni Inc. (Funoni.com). Funoni Inc. (Funoni.com) provides a marketplace platform for sellers (e.g event hosts) to sell event tickets on the Funoni Inc. (Funoni.com) platform. Funoni Inc. (Funoni.com) provides a marketplace platform for users(e.g end users, Funoni members etc.) to buy tickets from events listed on the Funoni Inc. (Funoni.com) platform. All ticket prices on Funoni Inc. (Funoni.com) are listed as U.S Dollars (USD). Ticket prices may change at any time prior to order confirmation.

Party Rental Booking

The Funoni Inc. (Funoni.com) Marketplace provides a platform for product companies(e.g Party Buses, Mechanical Bulls, Jumpers, Canopies, Generators, Chairs & Tables etc.) Party Rentals may get booked by a variety of clients(e.g event hosts, users, Funoni members etc.) by listing the party rentals of companies on the Funoni Inc. (Funoni.com) platform. Funoni Inc. (Funoni.com) provides a Marketplace for clients(e.g event hosts, users, Funoni members) to book party rentals(e.g mechanical bulls, jumpers, party buses) listed on the Funoni Inc. (Funoni.com) Marketplace platform. All party rentals booking prices are listed as U.S Dollars(USD) Product booking prices may change at any time prior to order confirmation.

End User SMS & MMS Notifications

As an end user of Funoni Inc. (Funoni.com) you subscribe to receive recurring SMS messages information of events, and party rentals (event prices, flyers, party rental prices, coupon codes, confirmation messages and more) Text STOP to stop. Message and data rates may apply. By subscribing to Funoni Inc. (Funoni.com) you consent to receive text messages sent by an automatic dialing system. Consent to this terms is not a condition of purchase.

End User Email Subscription

As an end user you subscribe to receive recurring email information of events, and party rentals (event prices, flyers, party rental prices, coupon codes, confirmation messages and more) You can unsubscribe from the mailing list by clicking unsubscribe. By subscribing to Funoni Inc. (Funoni.com) you consent to receive emails sent by an automatic mailing system. Consent to this terms is not a condition of purchase.

Funoni Member

By joining Funoni Inc. (Funoni.com) you are a Funoni member. As a Funoni Member, you may do the following Funoni Link You will be designated a unique affiliate link(Funoni Link). Funoni will track data(e.g link clicks, ticket sales etc.) You may promote the link via social media, having referrals click on your link to purchase tickets through Funoni Inc. (Funoni.com).

Pay Structure

Funoni Inc. (Funoni.com) offers a fifty percent commission based on the revenue your Funoni Link generates for Funoni Inc. (Funoni.com), not the price of the tickets listed on the Funoni Inc. (Funoni.com) Marketplace. Commissions will only be made from ticket sales.

Funoni Member

All payments made to Funoni Member will be determined by Funoni Inc. (Funoni.com) in sole discretion.

INDEPENDENT CONTRACTOR

(a) Funoni Member shall perform all the Services as an independent contractor of Funoni Inc. and nothing contained herein shall be deemed to create any association, partnership, joint venture, or relationship of principal and agent or master and servant, or employer and employee between Funoni Inc. and Funoni Member or any of its Affiliates, employees, or subcontractors thereof, or to provide either party with the right, power or authority, whether express or implied, to create any such duty or obligation on behalf of the other party. (b) Funoni Member also agrees not to be treated, or seek to be treated, as an employee of Funoni Inc. for any purpose, including for the purposes of fringe benefits provided by Funoni Inc. or for disability income, taxes, and benefits. Funoni Member's employees and subcontractors also shall not be deemed an employee of the Funoni Inc. for any reason whatsoever. Funoni Member hereby represents that Funoni Member has and at all times will maintain timely payments of all taxes due to the Income Tax Department and all other government agencies, including withholding and all other taxes. (C)Funoni Inc. shall not be responsible for federal, state and local taxes derived from Funoni Member net income or for the withholding and/or payment of any federal, state and local income and other payroll taxes, workers' compensation, disability benefits, retirement, insurance or other legal requirements applicable to Funoni Member.

Funoni Member SMS & MMS NOTIFICATIONS

By joining Funoni Inc. (Funoni.com) you subscribe to receive recurring SMS messages information of fun events, party rentals, and Funoni link data(impressions, clicks, ticket sales, commissions, confirmation messages, exclusive funoni member ticket discounts and more). Text STOP to stop. Message and data rates may apply. By joining Funoni Inc. (Funoni.com) you consent to receive text messages sent by an automatic dialing system. Consent to this terms is not a condition of purchase.

Funoni Member Email Subscription

By joining Funoni Inc. (Funoni.com) you subscribe to receive recurring email information of events, party rentals, and Funoni link data(impressions, clicks, ticket sales, commissions, confirmation messages, exclusive funoni member ticket discounts and more). You can unsubscribe from the mailing list by clicking unsubscribe. By subscribing to Funoni Inc. (Funoni.com) you consent to receive emails sent by an automatic mailing system. Consent to this terms is not a condition of purchase.

Referral Terms

A referral is a user who clicks on your link first before clicking on any other Funoni member links and joins Funoni Inc. (Funoni.com). Referral users may not join Funoni Inc. (Funoni.com) with multiple different email accounts, PayPal addresses, phone numbers, social media accounts. A referral user can only join Funoni Inc. (Funoni.com) once.

 

Referral Commission Structure

You will only receive a one-time payment of 10$ when your referral user earns 100$ US of commissions from Funoni Inc. (Funoni.com). Once You receive your one-time payment of 10$ for a referral user earning 100$ US you will not receive any more payments for any future commission earnings of the referral user. You may have multiple unique referral users .

Access of Invited Contacts Information

By using our email importer application you can select your email provider. (Gmail, Yahoo, Outlook, AOL, CSV, MailChimp, Eventbrite, Email). Once you select your email provider, you will be asked to login to your email account. Once you are logged in you will see a window with the permissions you are granting Funoni Inc. (Funoni.com)in order to access your contacts. Once you have granted permissions requested by Funoni Inc. (Funoni.com) your contacts will load and you will be able to select the contacts you want to invite to Funoni Inc. (Funoni.com)

Use of Invited Contacts Information

By using our email importer application you can select contacts by clicking invite and then clicking done. When you click invite all. All your contacts will receive an invite. By inviting email contacts you agree to the following, The contacts you (the funoni member) select will receive an invitation to join Funoni Inc. (Funoni.com). Your contacts will see your name so they know who invited them. Your invited contacts will also be imported to Funoni Inc. (Funoni.com). We will store information gathered from your contacts such as (Email, Name, Birthday, Phone Number, City) to help you sell more tickets, grow referrals by sharing your funoni link and improve Funoni Inc. (Funoni.com). By inviting email contacts you give us permission to provide invited contacts information about upcoming events, joining Funoni Inc. (Funoni.com), and other promotional messages. Your contacts will see your name and funoni link in this messages. (Ex: Bob would like to invite you to this fun upcoming event. Click here funoni.com/bob ) Funoni Inc. (Funoni.com) will send reminders in your name to contacts you have invited. Messages to contacts may be sent via email, SMS, and MMS. When we send messages to invited contacts, we may provide your name and funoni link so they know who is inviting to them to events or to join the funoni community. Contacts can click on your funoni link to buy event tickets. Whenever someone clicks on your link and buys a ticket you earn 50% commission of funoni ticket revenue generated from your link. Contacts can also join Funoni Inc. (Funoni.com) and become your referral by clicking on your funoni link and join the funoni community. Funoni Inc. (Funoni.com) may use email services like ( MailChimp, Get Response, Spark Post, Active Campaign, Maropost, Aweber, Emma)to contact invited contacts.

Storage of Invited Contacts Information

Funoni Inc. (Funoni.com) will store invited contacts information in a secure database. Funoni Inc. (Funoni.com) is the only party authorized to access, use this information. Funoni Inc. (Funoni.com) may share invited contact information with third parties services or tools that help Funoni Inc. (Funoni.com) contact and communicate with invited contacts only. Funoni Inc. (Funoni.com) may import invited contact information to email services like ( MailChimp, Get Response, Spark Post, Active Campaign, Maropost, Aweber, Emma) Funoni Inc. (Funoni.com) will not share invited contact information with other third parties.

Invited Contacts Communication Preferences

Invited contacts may opt-out by clicking unsubscribe, reply STOP via SMS, MMS, email and will no longer receive any messages with your name or funoni link. You may select contacts you do not want us to contacts about events, and joining Funoni Inc. (Funoni.com) by providing list of contacts you do not want us to send message to anymore by emailing us at on@funoni.com Once opted out contacts will no longer receive any messages from us under and see your name or funoni link.

Privacy

Your use of https://www.funoni.com is subject to Funoni.com's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications

Cancellation/Refund Policy

Ticket Refunds

Funoni Inc. (Funoni.com) will not issue refunds, cancellations or exchanges on any ticket sales. When you place a ticket order you have committed to the seller(e.g event host) that you are buying the tickets. Funoni Inc. (Funoni.com) is not responsible for any event cancellations, postponements or any other event changes. We will do our best to connect sellers(e.g event hosts) and buyers to solve any issues.

Party Rental Booking Refunds

Funoni Inc. (Funoni.com) will not issue refunds, cancellations or exchanges on any party rental bookings. When a booking is confirmed both the client and party rental company have committed to the booking. Funoni Inc. (Funoni.com) is not responsible for any party rental booking cancellations, postponements or any other changes. We will do our best to connect clients and party rental companies to solve any issues. Funoni Inc. (Funoni.com)is not responsible or liable for anything outside the Funoni.com marketplace platform.(e.g mechanical bull not functioning etc.) All such issues are to be solved between the client and product company.

Funoni Member Cancellation

To cancel Funoni Link, contact us at on@funoni.com with a brief explanation for cancellation and stop promoting Funoni link via social media. Once a cancellation is complete you will no longer be able to receive a fifty percent commission. Funoni Inc. (Funoni.com) will add you to an email list for promotions, news, offers and other purposes. To unsubscribe reply stop or click unsubscribe. For any other questions contact us at on@funoni.com

International Users

The Service is controlled, operated and administered by Funoni.com from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. Indemnification

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Employer agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Termination/access restriction

Funoni.com reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. Funoni.com's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Funoni.com's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Funoni.com with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Funoni.com with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Funoni.com with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
